CARI A. COHORN, an associate with Phillips, Erlewine & Given, is experienced in all phases of trial and appellate litigation, in both state and federal courts, as well in arbitration and mediation. Her accomplishments in litigation include, among others, successfully bringing and opposing motions for summary judgment, compelling production of purportedly privileged documents in a case of first impression in California, prevailing in several bench trials of employment-related matters, assisting in an appeal overturning an eight-figure verdict (including a hefty award of punitive damages) against her client, an employer accused of negligently hiring and supervising its workers.

Cari’s practice focuses primarily on labor and employment law, commercial litigation, and sports and entertainment law. In her labor and employment practice, Cari has represented both employees and management in all facets of both single-plaintiff and class actions in subject areas including harassment, discrimination, wage and hour, and wrongful termination. She has substantial experience in investigating, evaluating and responding to discrimination charges before administrative agencies and appearing before those agencies. Along with another firm attorney, Cari recently obtained a $1.1 million judgment against a departing employee for misappropriation of trade secrets. In addition to litigating, she provides clients with counseling and advice regarding a wide range of employment policies and practices, as well as training supervisory employees.

With regard to commercial litigation, Cari has handled allegations of breaches of fiduciary duty, consumer disputes over banking practices and fees, and allegations of unlawful “balance billing” by hospitals for emergency medical services. She second-chaired a jury trial of a hotly contested, bet-the-company dispute over ownership of a multi-million dollar book of business.

Cari’s sports and entertainment law practice encompasses litigation, transactional matters, and counseling of clients, primarily in the music and motion picture industries, as well as in professional and amateur sports. Cari handles domestic and international disputes over licensing agreements, as well as over alleged copyright and trademark infringement, both in state and federal courts and before the Trademark Trial and Appeal Board. Her sports law practice primarily includes drafting coach and player contracts and advising teams on risk management and employment law. In addition, Cari litigates sports-related matters, such as alleged liability against athletes and athletic facilities for sports injuries and disputes related to the purchase and financing of equipment for athletic facilities.

Cari frequently authors articles on topics related to her practice, which have appeared in publications such as Los Angeles Lawyer, HR Today, and the California Employment Law Letter.

Cari graduated magna cum laude, Phi Beta Kappa, from Southwestern University, with a degree in psychology, and earned a master’s degree in psychology from the University of Illinois, where her research focused on the measurement and impact of sexual and racial harassment and discrimination and on the use of social science research in making decisions (e.g., class certification, proper measures of damages) in civil litigation. Cari received her law degree from the University of California, Berkeley (Boalt Hall), where she was a member of the California Law Review. She remains active in the Boalt Hall community, including frequently serving as a judge for Boalt’s Appellate Advocacy program and McBaine Moot Court competition.
