Firm launches copyright infringement action over iconic Bay Area hip hop anthem

May 12, 2020 – Firm partner Nick Carlin and associate Kyle O’Malley today filed a copyright infringement lawsuit on behalf of client and Bay Area hip hop producer Darrell Jackson against Apple, NBCUniversal, and Steven Spielberg’s Amblin’ Entertainment, among others, alleging that the defendants infringed Jackson’s copyrights in the composition and sound recording of iconic 1989 hip hop anthem “Side Show” by prominently using that song in an episode of the recently-launched “Amazing Stories” series on Apple’s new video streaming platform, Apple TV+. In addition to the direct copyright infringement claims, Jackson’s lawsuit also seeks damages and injunctive relief against music publisher Nakamiche Muzic and its owners, including for claiming ownership of rights in “Side Show” and for licensing the work for exploitation in “Amazing Stories” without Jackson’s authorization.
