Court forces disclosure of financial data in right of publicity case

September 4, 2020 – San Francisco Superior Court judge Pro Tem Steven Stein today ordered Bay Area medical group Elite MD to turn over detailed financial information on its medical practice relating to firm client Anna DeAnda’s claim of violation of her right of privacy and publicity. Judge Stein agreed with firm attorneys Nick Carlin and Kyle O’Malley that under the pertinent state right of publicity statute the firm’s client was entitled to Elite’s profit and loss statements, balance sheets and cash flow statements. The client contends that Elite used photographs of her in advertising it arranged for on KRON-TV without her permission and against her express wishes. Judge Stein gave Elite 20 days to comply with his order. Further proceedings in the matter are pending.
