Partner provides litigation update on NFT cases to industry group

October 7, 2022 - Managing partner and experienced intellectual property and entertainment lawyer, David Given, presented a litigation update on cases involving NFTs at the 44th Annual Conference of the ABA Forum on the Entertainment and Sports Industries held in Las Vegas, Nevada. Nonfungible tokens (NFTs) are unique digital identifiers; they can be used to indicate or identify a digital version of a creative work. Litigation surrounding NFTs in this area has typically focused on the ability of the issuer of an NFT to grant rights to the creative work and whether issuers can use others’ intellectual property in creating NFTs. The cases identified in David’s presentation involve some of the world’s biggest brand names, including Nike, Hermès and the NBA, shaping the law governing NFTs. David is a former Chairman of the Forum and a former Editor In-Chief of its quarterly publication, the Entertainment and Sports Lawyer.
