Court enters final pretrial order in age discrimination case

July 26, 2021 – Federal district court judge Edward M. Chen today entered a final pretrial order in firm client Barbara Tavres’ age discrimination case against bookseller Barnes & Noble. Judge Chen’s order sets the stage for a two-week jury trial over claims that B&N engaged in discriminatory employment practices.

Ms. Tavres was a 20-year veteran of the book business and an award-winning sales representative for over 13 years at B&N. Her lawsuit against B&N contends that in her final year at the company she was passed over for promotion and later unceremoniously shown the door in favor of a colleague 30 years her junior with virtually no relevant sales experience.

Firm partner Randy Erlewine and associate Kyle O’Malley, who have been litigating the case for almost two years, lead the firm’s trial team. Opening statements are expected to begin on Monday, Aug. 16th at the federal courthouse in San Francisco.

UPDATE — August 13, 2021 — The Court filed these minutes of the final status conference before trial today.
